The above-named Plaintiff humbly states as follows:

1. The Plaintiff is an artificial person residing and working for gain within the Mvomero District in the Morogoro region, and her address for service for this suit is in the care of;- NICE Law Chambers Advocates, Join House 11th floor room 01, Gain Road, P. O. Box 1000 Morogoro.
2. The Defendant is a company that operates within the Mvomero District in the Morogoro region. Its address for service for this suit is:- BBB LTD

   Morogoro.
3. That, the Plaintiff’s Claim against the defendant is Tshs—100,000,000/=, arising out of the defendant’s Act of trespass to land and carrying out quarrying activities.
4. That the Plaintiff in 2030 acquired a lease in a piece of land located at Melela, Mvomero district for ten years for the purposes of carrying out the quarrying business on the leased land.
5. That in November 2035 it was discovered that Defendant trespassed on the same leased land at Melela, Mvomero district, and was carrying out quarrying operations, excavating stone, gravel and murram for road construction without the knowledge of the land owner. The Defendant therefore trespassed to that land.
6. That, the cause of Action arose in Mvomero District in Morogoro region and the matter being a tort, it suggests that your honorable Court has jurisdiction to determine the case since there is no District Court in Mvomero district.
